Trust Amendments

Trusts will often need to be modified in response to changing tax laws, goals, asset values, or cash flow needs. To minimize costs, an attorney may be able to amend a trust instead of creating an entirely new trust. Trust amendments are normally faster and lower cost than trust restatements unless the trust being amended was drafted with unfamiliar language. Trust amendments for revocable trusts are normally much simpler than amendments of irrevocable trusts. Irrevocable trust amendments, when feasible, will normally require consent of beneficiaries and/or court approval.
